Guys i finally received our receipt notices on Sept 24th 2007.
Self and spouse I-485/EAD/AP filed @ NSC on Aug 07th 2007
Receipt Date: August 08th 2007
Notice Date: Sept 14th 2007
LUD: 09/18/2007 on 485/EAD/AP
LUD: 08/12/2007 on I-140 pending at TSC.
Awaiting my FP notice/EAD/AP/I-140 approvals.

According to USCIS previous requirement, a person is required to work for the sponsoring employer for at least one year after obtaining the Green Card. There may be a problem when you want to apply for U.S. citizenship later, if you leave the sponsoring employer in a short period of time after obtaining the Green Card.
The AC-21 rule does not clear the issue of a person who leaves its employer after the I-485 approval, but it is better to take a conservative way to reduce the potential risk later.

Also, AC-21 allows to replace the GC employer to a new employer, but it does NOT change the intent to work for the employer after I-485 is approved.

I'm a july filer (July 16th)
have gotten EAD
Case status online says AP approved on Nov 2nd.
But NO FP.
Opened a SR on Oct 19th but don't have an appointment.
Called again yesterday and was told to call back on Nov 19th if I still don't have FP appointment.
Of the 6 filers at my job, only 2 got FP...very strange.

You are absolutely right. These frauds need to be stopped. Because of this fraud H1b quota is used up on the very first day and EB3 India has a backlog of seven years. If USCIS weed out all the frauds, I bet the wait for EB3 india will be no more than 3 years.
You are already out of status as H1 accounts for continuous employment along with regular pay. H1 visa, job and pay go hand in hand. Any one component missing means you are out of status.
There is no grace period. As the earlier member said, it is a gray area without any specific guidelines. I have seen people stay out of job (status) for 4 months and have used portability or consulate stamp upon getting a new job. It all depends on the IO.
BTW, did you ever realize how unethical it is to use a consultant for acquiring a H1 visa without actually having a fulltime job? For last 7 years I am on H1 myself and have played by rules� I hate people who false represent the facts for immigration benefits.
Because of people like you genuine candidates who have legitimate jobs are left out as you guys get lucky in the lottery even though you don�t have a regular fulltime job. My wife was forced to stay at home for almost 3 years because of people like you.. FYI she had a job offer (from a F500 Inc.) but people like you got lucky when it came to H1 lottery. Not just that but people like you give a bad name to legal immigrant community.

Thank you, texcan. FP may not be requierd for EAD renewal or first-time EAD? Mine is first time EAD. So, eseentially no FP yet for 485 (filed August 07) and first time EAD (this August)!

Congrats on EAD renewal. Enjoy and relax; please donot get in habbit of worry for anything and everything.
Anyways, paper based ead renewal donot require finger prints. Search the forum, this has been stated many time.

My attorney says it cud also result in delay of the process...its a 50-50 chance.
Dozn't matter whether u inquire or the attorney doz and thats why they have an option when u call whether u r a representative or the petitioner himself...Anyways if u think its worth a try go for it.
I think bottom line is it depends on the IO having ur case and sitting on it doing nothing...

So you are laid off so what is the big deal? You should be able to negotiate somehow or escape layoffs by doing something or the other. There are people in my company who survived 6 layoffs. Your layoff is your problem and nothing is fair in the globalization.

Friends - I went for FP appointment on 10/23/2007. But when I check USCIS website. The LUD still shows me 09/20/2007 on I-485. Please let me know if this is normal...

I just called USCIS. The woman was polite but she told me there is nothing she can tell me since it is still within 90 days and she cannot tell me the receipt number. :mad:

1) legals cannot undercut US jobseekers because of strict labor laws. Employers are paying a premium in wages as well as legal fees to retain their legal alien workforce. IT would be foolhardy of them to go through the hassle if local talent was easily available.
2) legals are in most cases paying taxes for which they may never realize the benifits like social security.
We need to let it be known in a firm polite manner that

2) we are not harming or displacing anyone.
